1. Purchase Price

The total purchase price of the puppy is $____________________________ with limited rights.

2. Spay/Neuter Agreement

Buyer agrees that the above-described puppy is being sold strictly as a pet and not for breeding purposes. Buyer agrees to spay or neuter the puppy by the age of 12 months, or within 30 days of veterinarian clearance, whichever comes later. Proof of spay/neuter must be provided to the Seller. Failure to comply may result in repossession of the dog without refund and possible legal action.

 

3. Health & Care Requirements

Buyer agrees to provide routine veterinary care, maintain a healthy environment, proper nutrition, and not keep the dog outdoors full-time. Seller retains the right to repossess the dog if these conditions are not met.

 

4. Return/Rehoming Clause

Should the Buyer be unable to keep the dog, the Seller retains the first right to reclaim the dog prior to any rehoming or surrendering. Buyer is prohibited from rehoming or surrendering the dog without Seller’s written approval. Buyer is responsible for return costs. No refunds will be issued. 

 

5. Repossession Clause

Seller reserves the right to reclaim the dog if neglected, abused, or contract terms are breached. Legal action and cost recovery may follow.

 

6. Health Disclaimer

It is understood that the Seller does not guarantee against common puppyhood conditions including: Parasites, Coccidiosis, Parvo, Dry Skin, Giardia, Addison’s Disease, Hypoglycemia, Hepatitis, Megaesophagus, Mange, Puppy Acne, Sebaceous Cysts, Allergies, Fleas/Ticks, Ear Mites, Heartworms, Cherry Eye, Knuckling, Infections, Stress, Diarrhea, Flat Feet, Infertility, Hip Dysplasia, Bloat, Temperament, Ectropion, Entropion, Visual/Cosmetic traits, Bacterial/Viral Infections, Uneven Bites, Undescended Testicles. Buyer acknowledges and accepts these risks without compensation.

 

6.1 - Items Not Covered or Guaranteed

The Buyer acknowledges and understands that the following common conditions, traits, and characteristics associated with a small breed are NOT covered, guaranteed, or eligible for refund, replacement, or compensation. These conditions arise due to the Small breeds natural conformation, genetics, or environment and can occur regardless of breeder care:

 

- PDE (Pug Dog Encephalitis): An inflammatory neurological disease common in Pugs.

- Dental and Jaw Problems: Including misaligned bites, retained or missing teeth, and       other jaw-related abnormalities.

- Orthopedic Issues: Including luxating patella’s, Legg-Calvé-Perthes Disease, hip dysplasia, or other bone and joint conditions associated with the breed.

- Spinal and Neurological Issues: Including hemivertebrae, intervertebral disc disease    (IVDD), and other spinal anomalies.

- Eye Disorders: Including cherry eye, entropion, ectropion, dry eye (KCS), corneal dystrophy, glaucoma, corneal ulcers, and other common eye-related conditions in small breeds.

- Breathing and Respiratory Issues: Including snoring, reverse sneezing, or other brachycephalic-related breathing characteristics.

- Stenotic Nares: Narrowed nostrils common in Pugs and other brachycephalic breeds.

-Mitral Valve Disease: A common cause of heart murmurs in older Chihuahuas.

Patent Ductus Arteriosus (PDA): Congenital heart defect seen occasionally in toy breeds.

- Soft Palate or Elongated Palate: Common traits in Pugs that can cause breathing difficulty and may require veterinary intervention.

- Nasal Fold and Skin Fold Infections: Including yeast infections or irritations due to the skin folds of the Pug’s face.

- Snoring or Noisy Breathing: Common characteristics of brachycephalic breeds.

- Allergic Reactions or Sensitivities: Including seasonal allergies or food sensitivities.

- Joint or Growth-Related Issues: Including luxating patella’s, hip dysplasia, or other orthopedic concerns associated with the breed.

- Obesity: Including weight gain that can be influenced by genetics and metabolism, making it the owner’s responsibility to manage nutrition and exercise.

-Tooth & Gum Disease: Because of their small mouths, teeth can crowd, leading to plaque, tartar, and early tooth loss.

- Reproductive Challenges: Including infertility, dystocia (difficulty giving birth), or other breeding-related complications.

- Temperament: The Seller is not responsible for behavioral characteristics that arise due to environment, training, or socialization.

- Size, Color, or Physical Appearance: The Seller does not guarantee adult size, weight, color, or any specific physical feature.

 

Buyer understands and accepts that these conditions are inherent in a small breed and agrees that the Seller is NOT liable for any veterinary costs, treatments, or financial reimbursement related to any of the above conditions, regardless of their origin or onset.

 

7. Public Exposure Warning & Liability Disclaimer

If you choose to take your puppy out in public (e.g., dog parks, pet stores, sidewalks, or other populated areas), please use extreme caution and monitor your puppy for any signs of illness. Your puppy has only received his/her first round (and in some cases, second round) of vaccinations and is not guaranteed to have full immunity. Exposure to other animals or contaminated environments can place your puppy at risk for serious illnesses, including Parvovirus, which can be fatal if not detected and treated promptly.

Note: It can take up to 14 days after vaccination for the immune system to recognize and respond to antigens effectively.

 

Once the puppy leaves the Seller’s possession, the Seller assumes no liability for any illness, injury, or death due to public exposure, contact with other animals, improper quarantine, or lack of preventative care.

 

8. No Other Warranties

No other warranties are provided. Buyer understands that outcomes may vary depending on individual development and care.

 

9. Entire Agreement & Legal Jurisdiction

This is the complete agreement. It is governed by the laws of the State of Minnesota, and any disputes will be resolved in Morrison County, Minnesota.  If any part of this agreement is found unenforceable, the rest of the agreement will remain in full force. In the event of enforcement proceedings, the prevailing party is entitled to recovery of reasonable attorneys’ fees and court costs.

 

10. Holding Fee & Delivery Policy

A non-refundable holding fee of $200.00 is required to reserve a puppy. No puppy will be held without a paid holding fee.

 

If delivery is requested, 50% of the delivery fee must be paid in advance before the puppy leaves the Seller’s possession and to confirm delivery scheduling. Delivery fees are non-refundable once travel has been scheduled.

11. Social Media and Photos

The Buyer grants permission for the Seller to use images or updates of the dog for advertising, websites, or social media platforms.

 

The remaining balance (including delivery fee, if applicable) is due in cash only at the time of pickup or delivery. Failure to pay the full balance will result in forfeiture of the puppy and all prior payments made. The Buyer acknowledges having read and fully understood the agreement and agrees to abide by its terms and conditions.
